Terms of Service
Before using "Exevoice" (the "Service"), provided by trisaveurs ("we", "us"), please read these Terms of Service (the "Terms"). You may use the Service only if you agree to them.
Article 1 (Application)
These Terms apply to every aspect of the relationship between you and us concerning your use of the Service.
We may set out other rules and provisions for the Service (the "Individual Provisions"), whatever they may be called. The Individual Provisions form part of these Terms.
If these Terms conflict with the Individual Provisions, the Individual Provisions prevail unless they state otherwise.
Article 2 (Registration)
Registration is complete when an applicant agrees to these Terms, applies in the manner we specify, and we approve the application.
We may decline an application if we judge that any of the following applies, and we are under no obligation to disclose our reasons.
- The applicant provided false information in the application
- The applicant has previously breached these Terms
- We otherwise judge that registration is not appropriate
Article 3 (Age requirement)
The Service is available only to people aged 13 or over. People under 13 may not use the Service.
If you are 13 or over but under 18, please obtain the consent of a parent or other legal guardian before using the Service.
Article 4 (Consent to voice recording and processing)
You agree that the Service records audio, and that the audio is sent to and processed by the following outside services for transcription and for organizing by AI.
- OpenAI (transcribing the audio)
- Anthropic (organizing the text and generating summaries)
The recorded audio is discarded once transcription finishes and is not stored on our servers. Session records organized by AI are stored so that only you can read them. See Article 4 of the Privacy Policy for details.
If you record another person's voice, it is your responsibility to obtain that person's consent. We are not responsible for any trouble arising from recording another person's voice without their consent.
Article 5 (Managing your user ID and password)
You are responsible for managing your user ID and password for the Service appropriately.
You may not under any circumstances transfer, lend or share your user ID and password with a third party. Where a login is made with a combination of user ID and password that matches the registered information, we treat that use as use by the registered user.
Except where we have acted intentionally or with gross negligence, we are not responsible for any loss arising from use of your user ID and password by a third party.
Article 6 (Prohibited conduct)
You must not do any of the following when using the Service.
- Anything that violates laws or public order and morals
- Anything connected with criminal activity
- Anything that infringes copyright, trademark or other intellectual property rights in the Service or its contents
- Anything that destroys or interferes with the functioning of servers or networks belonging to us, other users or third parties
- Using information obtained through the Service for commercial purposes
- Anything that risks interfering with the operation of our services
- Gaining or attempting to gain unauthorised access
- Collecting or storing personal information about other users
- Using the Service for improper purposes
- Anything that causes disadvantage, loss or discomfort to other users or third parties
- Impersonating another user
- Advertising, promotion, solicitation or business activity on the Service that we have not permitted
- Anything intended to meet strangers for romantic purposes
- Providing benefit, directly or indirectly, to anti-social forces in connection with our services
- Recording another person's voice without their consent and uploading it to the Service
- Anything else we judge to be inappropriate
Article 7 (Suspension of the Service)
We may suspend or interrupt all or part of the Service without notice to you if we judge that any of the following applies.
- Maintenance, inspection or updating of the computer systems for the Service
- Force majeure such as earthquake, lightning, fire, power failure or natural disaster makes provision of the Service difficult
- Computers or communication lines stop due to an accident
- A failure or specification change in an outside service we use (OpenAI, Anthropic, Supabase, Google and others) makes provision of the Service difficult
- We otherwise judge that provision of the Service is difficult
We are not responsible for any disadvantage or loss suffered by you or a third party as a result of the suspension or interruption of the Service.
Article 8 (Restriction of use and cancellation of registration)
We may, without prior notice, restrict your use of all or part of the Service, or cancel your registration, if any of the following applies to you.
- You breach any provision of these Terms
- Your registered details are found to contain false information
- You do not respond to contact from us for a certain period
- You do not use the Service for a certain period after your last use
- We otherwise judge that your use of the Service is not appropriate
We are not responsible for any loss you suffer as a result of action we take under this Article.
Article 9 (Withdrawal)
You may withdraw from the Service at any time.
How to withdraw: open the "Settings" screen in the Service and choose "Delete account".
Please note the following when you withdraw.
- Deletion of your account takes effect immediately and cannot be undone. Deleted session records, full transcripts and other data cannot be restored.
- If you have a paid plan, deleting your account does not automatically cancel that contract. Please cancel it separately in the manner set out in Article 10.
Information after withdrawal is handled in accordance with the Privacy Policy.
Article 10 (Fees and paid plans)
In addition to the Free plan, which is available at no charge, the Service offers the following paid plans.
- Light plan (monthly)
- Standard plan (monthly / yearly)
- Pro plan (monthly / yearly)
The current fees, monthly recording time and other features of each plan are those we display in the Service or on the App Store.
Purchase, payment, billing and refunds for paid plans are governed by the App Store terms set by Apple Inc. Fees are charged through the App Store to the payment method linked to your Apple ID.
Paid plans renew automatically. Unless you cancel at least 24 hours before the end of the contract period (one month for monthly plans, one year for yearly plans), the contract renews automatically for the same period and the applicable fee is charged.
You can cancel a paid plan from the subscription management screen in the "Settings" app on your iPhone or iPad. We do not cancel on your behalf.
We do not, as a rule, provide pro-rata refunds for cancellation partway through a billing period. If there are individual circumstances that you believe warrant a refund, please use the App Store refund request process.
We may change the fees, scope and other conditions of paid plans at any time. If we make a change that is disadvantageous to existing users, we will give notice in the Service or by email to your registered address at least 30 days before the change takes effect.
Please also see Article 10-2 regarding the conditions of use for recording sessions.
Article 10-2 (About recording sessions)
Exevoice is designed around the experience of saying what you were thinking, just as it came to you. Short murmurs and long reflections alike matter to us, and both accumulate equally as your words.
The Service is run by an individual developer. If we observe a pattern of use that differs from this design intent - for example, extremely short phrases recorded intermittently and repeatedly over a long period - we may limit the number of sessions per month so that the Service can continue over the long term.
The monthly limit on recording time is stated for each plan. For the number of sessions, we set an operational limit, designed at a level that ordinary use does not reach.
Article 11 (Disclaimer of warranties and limitation of liability)
We do not warrant, expressly or impliedly, that the Service is free from defects in fact or in law (including defects, errors, bugs and infringements relating to safety, reliability, accuracy, completeness, effectiveness, fitness for a particular purpose and security).
We are not responsible for any transaction, communication or dispute arising between you and another user or a third party in connection with the Service.
In particular, the Service transcribes and organizes text using AI speech recognition and natural language processing, and we do not warrant the accuracy, completeness or fitness for a particular purpose of the output. How you treat and use the output is your own decision and responsibility.
Article 12 (Changes to the Service)
We may change the content of the Service or stop providing it without notice to you, and we are not responsible for any loss you suffer as a result.
Article 13 (Changes to these Terms)
We may change these Terms at any time without notice to you if we judge it necessary.
If you begin using the Service after these Terms have changed, you are deemed to have agreed to the changed Terms.
Article 14 (Handling of personal information)
We handle personal information obtained through your use of the Service appropriately, in accordance with our Privacy Policy.
Article 15 (Notices and contact)
Notices and contact between you and us are made in the manner we specify. Unless you notify us of a change in the manner we separately specify, we treat your currently registered contact details as valid, send notices or contact to them, and those notices are deemed to have reached you at the time of sending.
Article 16 (Prohibition of assignment)
You may not assign to a third party, or offer as security, your position under the use agreement or your rights or obligations under these Terms, without our prior written consent.
Article 17 (Severability)
Even if any provision of these Terms, or part of one, is held to be invalid or unenforceable under the Consumer Contract Act or other laws, the remaining provisions of these Terms, and the remainder of any provision held partly invalid or unenforceable, continue in full force and effect.
Article 18 (Method of notice)
Notices from us to you are given by posting within the Service, by email to your registered address, or by any other method we judge appropriate.
Article 19 (Governing law and jurisdiction)
These Terms are governed by and construed in accordance with the laws of Japan.
If a dispute arises in connection with the Service, the Tokyo District Court has exclusive jurisdiction by agreement as the court of first instance.
Article 20 (Language)
The Japanese text of these Terms is the authoritative version. The English version is a translation provided for reference; if there is any discrepancy between the Japanese and English versions, the Japanese version prevails.
